DMCA & Copyright Policy

JOTA respects the intellectual property rights of others and expects users of the Platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512), we will respond expeditiously to notices of alleged copyright infringement that comply with the requirements below.

Filing a Notice of Infringement

Send a written notice to our Designated Copyright Agent that includes all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it (URL, screenshot, etc.).
  4. Your contact information: name, address, telephone number, and email.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Counter-Notice

If you believe material you posted was removed by mistake or misidentification, you may submit a counter-notice containing the information required by 17 U.S.C. §512(g)(3), including your consent to jurisdiction in the federal district court for the judicial district in which your address is located (or, if outside the U.S., the Northern District of California), and consent to service of process from the person who submitted the original notice.

Repeat Infringers

JOTA will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also limit access to the Platform and remove material at our sole discretion.

Misrepresentations

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be liable for damages. Do not submit false claims.
